COLORADO SPRINGS, Colorado (AP) -- A man accused of fatally shooting someone in a car has been acquitted of first-degree murder under a state law that provides legal protection to homeowners who defend themselves.

But a legislator says the 1985 law -- known as the "Make My Day" law -- may have been misinterpreted by the jury.

Gary Lee Hill, 24, faced charges in the 2004 killing of 19-year-old John David Knott, who along with three others had assaulted Hill in his home.

Hill was accused of firing a shot into a car that Knott was driving. Knott crashed into a house and died from a single gunshot wound to the back, authorities said.

"It's a miscarriage of justice," said Sen. Jim Brandon, who helped craft the law. The law meant a home's door to be a threshold for an illegal entry, not down the street, he said.

Prosecutor Lisa Kirkman said the law says deadly force can be used "if the shooter reasonably believes the other person might use physical force against the home dweller."

According to testimony, Knott and the others showed up at Hill's house after an argument over a missing purse.

"Gary went through this horrible and traumatic event," said defense attorney Ted McClintock. "They promised they were going to come back in. They had already come back once."

We have good, strict, and reasonable laws here in Ohio as to when you can defend yourself with force. You can’t shoot someone when they are fleeing and you can’t shoot someone for stealing your stuff. There has to be a definite and unavoidable danger to you or another person’s life and health. And I think you still have to follow the force continuum and use only equal force like if someone jumps you to beat you down barehanded you don’t shoot them. If they have a weapon that can kill you you can use equal force and shoot. The prospect of having to ever shoot someone is something I don’t take lightly and even if I were justified I would have a hard time carrying that for the rest of my life. But as they say, better to be tried by 12 than carried by 6.

Guns-In-Bars Law Sponsor Arrested For DUI With A Gun


The sponsor of the law that made it legal to carry a gun into bars in Tennessee is facing charges of possession of a handgun while under the influence and drunken driving.

Rep. Curry Todd, a Collierville Republican, was pulled over in Nashville late Tuesday, according to court documents. Police said he failed a roadside sobriety test and refused to take a Breathalyzer test. A loaded .38-caliber gun was found in a holster stuffed between the driver's seat and center console.

A police affidavit said Todd was unsteady on his feet, "almost falling down at times." Officers concluded that Todd was "obviously very impaired and not in any condition to be carrying a loaded handgun."

During the 2009 debate over the bill, Todd assured lawmakers that gun permit holders would be careful about not violating the ban on drinking in bars or restaurants while carrying a gun.

"The burden is not going to be on the restaurant owner, it's going to be on the individual, because he's going to know that he has a chance there if he's caught to lose his gun permit forever," Todd said.

Violin and rosey are jsut still mad that the 2nd was judged to be an individual right, that concealed carry has spread like wildfire through the US, and that Obama caused the single biggest increase in private firearms purchases in the nation's history. :)

Todd's GMC Envoy was stopped while going 60 mph in a 40 mph zone in a neighborhood surrounding Vanderbilt University, said police spokesman Don Aaron. The vehicle was weaving and crossed the double yellow lines, he said.

State law makes it a misdemeanor for anyone to consume alcohol while carrying a firearm in public, and those who violate that law are subject to losing their permits for three years.
